How do the Orlando courts determine bail amount?

While your bail amount is completely up to the judge that oversees your case, they generally make a decision based on two questions:

  1. How likely are you to appear?
    If you have a history of not appearing or have had multiple arrests in the past, then the judge is more likely to set a higher bail amount.
  2. How serious was your charge?
    The more serious your alleged offense is, the higher that your bail is likely to be. If you are considered a public safety risk because you threatened the victim with a weapon or verbal abuse, then the judge will most likely set your bail amount higher.

It is important to keep in mind that the purpose of a bail is not to punish the defendant, only to give incentive for the accused person to come to their hearing. Excessive bail, that is a bail amount that is obviously higher than what is necessary, is a constitutional violation of your rights. The judge must state the reasons for setting the bail higher than the normal amount.
